Summary February 4, 2008

The Dare County Board of Commissioners met in a regular session at 9:00 a.m. on February 4, 2008 in the Dare County Administrative Annex in Manteo. Commissioners present were: Warren Judge, Virginia Tillett, Allen Burrus, Richard Johnson, Jack Shea, Mike Johnson, and Max Dutton. Also present was County Attorney Bobby Outten. County Manager Terry Wheeler was absent. Chairman Judge called the meeting to order. He called on Commissioner Mike Johnson to offer prayer followed by the pledge of allegiance to the flag. The Board then voted to amend the agenda by removing Item 6 and adding an appointment to the Oregon Inlet and Waterways Commission to Item 11.

ITEM 1 – PRESENTATION OF COUNTY SERVICE PINS

  1. Aye Soe, in-Home Service Aid, received her 10 Year Pin from Sue Hewitt, In-Home Aide Supervisor II.
  2.  Terence Sheehy, EMS Lieutenant, received his 10 Year Pin from Skeeter Sawyer, EMS Director.

ITEM 2 – EMPLOYEE OF THE MONTH
Crystal Sidwell, Airport Administrator, received the Employee of the Month Certificate from George Wood, Chairman of Airport Authority and Acting Interim Airport Director.

ITEM 3 – PRESENTATION OF CRIMINAL INVESTIGATOR’S CERTIFICATE
Deputy Jody Lewis received his Criminal Investigator’s Certificate from Rodney Midgett, Sheriff.

ITEM 4 - PUBLIC COMMENTS
No one came forward to speak.

ITEM 5 – OUTER BANKS GUN CLUB
Chairman Judge and Commissioner Mike Johnson presented the Meritorious Service Award to Colonel William (Bill) H. Beadling for exceptional public service. Colonel Bill’s dedication to a vision and his “hands on” leadership are solely responsible for the creation of the Dare County Shooting Range and the Outer Banks Gun Club. Bill’s tireless efforts over many years of hard work have produced a shooting range for Dare County that is the “gold” standard for others. Mrs. Beadling (Gladys) was also present.

ITEM 6 – NORTH CAROLINA WATERMEN UNITED
This item will be rescheduled.

ITEM 7 – RESOLUTION FOR CLEAN WATER TRUST FUND APPLICATION
County Attorney Bobby Outten informed the Board that in order to secure additional funding for the construction of the Stumpy Point Wastewater Treatment Plant, it will be necessary to submit a revised application. One element of that application that is required by the NCCWMTF is a resolution by the agency requesting funds. In this case, the applicant will be the Stumpy Point Water and Sewer Authority. The Dare County Board of Commissioners recessed and convened as the Stumpy Point Water and Sewer District Board of Commissioners. They adopted the attached resolution (NC Clean Water Management Trust Fund, Wastewater Collection and Treatment System Project).

Commissioners then recessed the Stumpy Point Water and Sewer District Board of Commissioners and reconvened as the Dare County Board of Commissioners.

ITEM 8 – SITE PLAN FOR THE NEW ADMINISTRATION BUILDING
Sandra Williams of Heery International made a presentation to Commissioner by providing the updated site plan for the new Administration Building showing the proposed addition for the Commissioners meeting room.
See attached.

Following the presentation, Commissioners voted to approve the site plan and floor plan for new Administration Building. The site plan will now be submitted to the Town of Manteo for approval. The County Attorney pointed out that the Board is not approving construction of the addition and that is something that the Board will determine once the final costs for the addition are determined. Commissioner Johnson wanted to be sure that the Board would not be required to build the project if the site plan is submitted and costs come in high; he was assured that this is being done to move the project forward if the Board decides to build the addition in the future and that it would not mean that the structure has to be constructed.

ITEM 9 – UPDATE ON OREGON INLET BRIDGE
Vice Chairman Burrus reported that by September a contract will be let for the bridge.

ITEM 10 – CONSENT AGENDA
Commissioner approved the Consent Agenda containing the following items:

  1. Fire Department Contract and Agreement
  2. Advertise 2007 Tax Year Liens
  3. Fiber Line to Frisco Satellite Office

ITEM 11 – BOARD APPOINTMENTS

  1. ALBEMARLE COMMISSION BOARD OF DIRECTORS
    Commissioners voted to appoint Perry White to serve a two year term on the Albemarle Commission Board.
  2.  BOARD OF EQUALIZATION AND REVIEW
    Commissioner voted to appoint Skip Jones to serve a one year term on the Board of Equalization &Review.
  3. NURSING HOME COMMUNITY ADVISORY COMMITTEE
    This appointment will be made at a future meeting once a required letter is received from Spring Arbor.
  4.  PLANNING BOARD
    Commissioners voted to appoint David Overton (At-Large), Beth Midgett (District Four), and Bob Woodard (District Two) to serve a three year term on the Planning Board.
  5.  OREGON INLET AND WATERWAYS COMMISSION
    Ernie Foster was appointed to fill the unexpired term of Ephraim O’Neal on the Oregon Inlet and Waterways Commission.

ITEM 12 – COMMISSIONERS’ BUSINESS
Commissioner Max Dutton – thanked employees for their service and congratulated Crystal Sidwell as employee as the month.

The Manns Harbor Fire Department Appreciation Dinner will be held on February 7 at 6:00 p.m. at the Community Center.

Community Development Corporation – permitting process is now in place and waiting for everything to be approved. Nature’s Walk in KDH – 5 units for sale at $170,000 each and 5 units have already sold.

Commissioner Virginia Tillett – She attended a meeting of Cooperative Extension Advisory Council last month and there is concern about the use of public schools for their summer programs due to fees. She asked Commissioners Dutton and Shea to work with the School Board so that the program can continue this summer without increasing costs for participants.

On April 24, she will attend a training session at the 4H center in Columbia.

Last Monday, she attended the Nursing Home Advisory Committee Older Adult meeting – new officers were elected. Kaye White will act as mentor to the new chairperson, Frank Hester.  Lib Fearing will remain secretary. Be sure to thank Kaye for her good work on this committee.

Last Thursday, the Roanoke Island Senior/Community Center Advisory Group – it was a good meeting and she is counting on the CIP committee to bring this project to the front burner.

A Caregiver’s Education Conference will take place in Edenton in February and a group will attend to help with ideas for the summit that is being planned for Dare County.

Commissioner Richard Johnson – He asked that the Stormwater Committee that is looking at proposed regulations provide a monthly report to keep everyone updated.

Albemarle Mental Health is going to request a meeting to inform elected officials in various counties about in the laws and state funding. There are some critical issues that are coming up. Everyone needs to realize what is happening. He asked everyone to be ready to attend to learn about this important issue.

Vice Chairman Allen Burrus – offered congratulations to employees who were recognized this morning. There are many fine employees working for Dare County.

Thanked Ephraim O’Neal for the time and effort that he has put into volunteering for the county on the Oregon Inlet and Waterways Commission and in other ways.

He asked if the Health Dept. can be asked to look into historical data (genealogy and geographic data for cancer) – There are areas in the county where there seems to be extremely high cancer rates. Board gave their approval for him to pursue this with the Health Department.

He suggested that the Board look at ways to diversify our local economy and find sustainable ways to provide year around employment.

Commissioner Jack Shea – He agrees that it would be a good idea to try to rule out causes of cancer in Dare County by looking at historical data.

He congratulated Crystal as Employee of the Month. He also commented on the large amount of litter along the local roadways and asked that DOT put up “No Littering” signs. A letter will be drafted.

Commissioner Mike Johnson – He agrees that 4H does need help with facilities for their summer programs – they do an awesome job with kids. With the economy tight, these programs for children become even more important. Need a plan to address facilities for the summer.

Thanked Commissioners for their help (and school system) for their help with the hunting program. He was at the shooting range yesterday – almost 65 kids participated and it was a great day.

Capt. Allen Miller with NC State Highway Patrol will hold a meeting to review the advantages and disadvantages of the VIPER system. The meeting will be scheduled for later this week and everyone is welcome to attend.

Commissioner Virginia Tillett was appointed to the Library Board to fill the term of Commissioner Johnson.

Chairman Warren Judge – Principal Artie Tillett of First Flight High School was named the NE District Principal of the Year. Congratulations to him.

Interfaith Community Outreach had their annual meeting last week. In 2007, they helped over 1000 households. Bill Pitt and Jack Mann were honored as volunteers of the year.

Stormwater Rules – he and staff have reviewed the latest version of the rules as they have been rewritten and the Planning Department and Attorney will draft questions and will be asking for interpretation. How will they affect us? Who will interpret the rules and how will they be interpreted? He will ask a representative from the state to attend a March meeting to address some of the issues.

The Short Session will convene in May and new rules are expected to go into effect this summer. Commissioner Mike Johnson asked whether the Bowsertown Project will be affected by the new rules – DWQ has told attorney that anything already in the pipeline will not be affected by new rules.

Cancer Initiative - Judge said 6 applications have been received for the first patient navigator position for the cancer initiative. Rich Goldberg – doctor in charge of Lineberger Institute - is scheduling specialists and subspecialists. They are working with local doctors to determine how UNC will have presence. They are also working with the Town of Nags Head and Outer Banks Hospital to establish signage at the hospital location. It is coming along well. They may be able to look into the issue mentioned by Commissioner Burrus regarding data relating to cancer patients.

Substance Abuse – the County is a short time away from having the substance abuse treatment component up and running. Anne Thomas will come to a meeting to provide an update. She will also report about the Healthy Carolinians report that was unveiled last week.

ITEM 13 – UPCOMING BOARD APPOINTMENTS FOR MARCH
The upcoming Board Appointments for March are Nursing Home Community Advisory Council and Workforce Development Board.

ITEM 14 – CLOSED SESSION / APPROVAL OF MINUTES OF LAST CLOSED
SESSION

Vice Chairman Burrus, pursuant to NCGS 143-318.11 moved that the Dare County Board of Commissioners go into closed session to approve the minutes of the last closed session. Following the closed session, Attorney Outten reported that the Board of Commissioners approved the minutes of the last closed session.
